Acknowledgement of Risk and Participant Waiver

I am aware that gymnastics and cheerleading are vigorous sporting activities involving height and rotation in a unique environment and as such they pose a risk of injury. In consideration of the acceptance of my participation and/or the participation of my child or ward in gymnastics at Gymnastics Plus, and with the understanding that my child may be injured in the course of running, jumping, climbing, swinging, or other activities routinely performed by children at Gymnastics Plus. I understand that gymnastics, cheerleading and related activities always involve certain risks, including but not limited to death, serious neck and spinal injuries, brain damage and serious injury to virtually all bones, joints, muscles and internal organs.  I understand that mats and other safety equipment and apparatus provided for my or my child’s protection, including the active participation of a coach or teacher who will spot or assist in the performance of certain skills may be inadequate to prevent serious injury.  I understand the risk of harm may be limited by all of the safety equipment and coaches, but never eliminated.   I further understand that participation in gymnastics and related activities involves activities incidental to active participation in gymnastics, including moving from event to event, conditioning, stretching and other activities which may leave the participant vulnerable to the reckless actions of other participants who may not have complete control over their actions or knowledge of the risks involved and hereby agree to accept any and all inherent risks of property damage, personal injury or death. 
 
I agree to assume the risks incidental to such participation, including, but not limited to, those risks set forth above and I, on behalf of my child or ward, and on behalf of my child’s or ward’s heirs, executors and administrators, release and forever discharge the released parties defined below from any liabilities, claims, actions, damages, costs or expenses of any nature, arising out of or in any way connected with my or my child’s participation in such gymnastics activities and further agree to indemnify and hold the released parties harmless against any and all such liabilities, claims, actions, damages, costs or expenses, including, but not limited to, attorney’s fees and disbursements. I hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by me, my family, estate, heirs or assigns.  I hereby agree to individual provide for all present and possible future medical expenses which may be incurred by myself or my child as a result of any injury sustained while participating at or for BRAG, LLC.

I understand by execution of this agreement that I am releasing BRAG, LLC for their own negligence, actions or inactions:  I agree that this release and indemnity agreement includes any claims for the negligence, actions or inactions of any of the above-released parties and covers bodily injury on behalf of my minor children suffered by my child or ward before, during or after participation in the gymnastics program.  In consideration of my participation, I hereby release and covenant not to sue BRAG LLC., the Gymnastics Plus/ BRAG LLC officers, directors, employees, agents, representatives, successors, teachers, or coaches from any all present and future claims resulting from ordinary negligence of BRAG, LLC .or others listed for property damage, personal injury or wrongful death, arising as a result of my engaging in or receiving instruction in gymnastics, cheerleading or any other activities or any activities incidental thereto, wherever, whenever or however the same may occur.

I also understand that BRAG, LLC retains the rights to use any photographs, videos, motion pictures recordings, or any other media for publicity, advertising, or any legitimate purposes. 

I am required to drop off and pick up all children inside the facility and on time.  Gymnastics Plus / BRAG, LLC cannot be responsible for any child dropped off or picked up outside of the facility or those who are not picked up on time. 

I have read and understand this acknowledgment of risk and waiver of liability and I voluntarily affix my name in agreement.
